The letter stated that Zhao pleaded guilty in 2023 to violating the U.S. Bank Secrecy Act, admitting to failing to establish an effective anti-money laundering mechanism, which constitutes a criminal offense. The letter emphasized that the relevant plea agreement and the Department of Justice press release were publicly available, and the defamation allegations were baseless. According to a U.S. Department of Justice press release dated November 21st, 2023, Binance and its CEO Changpeng Zhao pleaded guilty to federal charges including violating the Bank Secrecy Act, illegal money transfers, and violating sanctions, and agreed to pay over $4 billion in fines. This case marks the first time criminal charges have been brought against an executive of a major crypto company. Warren's team cited this announcement, stating that her statement regarding Changpeng Zhao's "pleading guilty to money laundering" was true and did not constitute defamation.
